• Shipping Limitations. When an order is placed, it will be shipping to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Web Site. All purchases from this Web Site are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from this Web Site pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

 By using the BOOMCHAIR site, you expressly agree that use of the BOOMCHAIR site is at your sole risk. The site is provided on an "AS IS" and "as available" basis. LUMISOURCE, its affiliates, subsidiaries or designees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively, "Associates") warrant that use of the site will be uninterrupted or error-free. Neither LumiSource nor its Associates warrant the accuracy, integrity or completeness of the content provided on the Best Buy Web site or the products or services offered for sale on the BoomChair.com Web site. Further, LumiSource makes no representation that content provided on the BoomChair Web site is applicable to, or appropriate for use in, locations outside of the United States. LumiSource and its Associates specifically disclaim all warranties, whether expressed or implied, including but not limited to warranties of title, merchantability or fitness for a particular purpose. No oral advice or written information given by LumiSource or its Associates shall create a warranty. Some states do not allow the exclusion or limitation of certain warranties, so the above limitation or exclusion may not apply to you.

Under no circumstances shall LumiSource or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use the BoomChair Web site, including but not limited to reliance by you on any information obtained from the BoomChair Web site that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance. The foregoing Limitation of Liability shall apply in any action, whether in contract, tort or any other claim, even if an authorized representative of LumiSource has been advised of or should have knowledge of the possibility of such damages. User hereby acknowledges that this paragraph shall apply to all content, merchandise and services available through the BoomChair.com Web site. INTENDED FOR USERS OVER 13
The BoomChair Web site is intended for use by individuals 13 years of age or older. The BoomChair.com Web site is not directed for use by children under the age of 13. Users under the age of 13 should get the assistance of a parent or guardian to use this site. The products are also for adults only and should not be used by Children under the age of 13.

ERRORS ON OUR SITE
Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and LumiSource reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, LumiSource will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with LumiSource's Return Policy.

SALES TAX POLICY

BoomChair.com collects and remits sales tax as required by U.S. law, for transactions in our stores and on BoomChair.com

PAYING FOR YOUR ORDER

Your credit or Debit Card will be charged on the same day you place your order. The only exception to this is if your item is on backorder. You will see a backorder statement on items that are not available until a certain date. After you place an order using our shopping cart, we will check the information you give us for validity, by verifying your method of payment or shipping address. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the e-mail address you have given us with the order.
Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card.

 ORDER ACCEPTANCE/CONFIRMATION

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The BoomChair Web site reserves the right at any time after receipt of your order to accept or decline your order for any reason.

RETURN POLICY

All sales made through the BoomChair website are subject to our return policy and warranty.

LIMITED WARRANTY: LumiSource, LLC. (“LumiSource”) warrants this product against defects in materials and workmanship for a period of ninety (90) days from the date of original consumer purchase. If a covered warranty claim is timely made, LumiSource® will, at its sole discretion: (a) repair the product, using new and/or refurbished replacement parts or (b) replace the product with an identical (or comparable) product, without charge to you other than the initial shipping cost to return the product. LumiSource® will only pay return shipping charges for destinations within the 48 continguous U.S.A., if the returned product is covered by the limited warranty.

WHAT THIS WARRANTY DOES NOT COVER: This warranty does not cover defects resulting from accidents, alterations, unauthorized repair, failure to follow instructions, misuse, commercial use, fire, flood, or acts of God.

WHAT WE ASK YOU TO DO: If there is a covered defect, please write or email us within 90 days of the date of purchase at the address noted on page 8 to obtain instructions and authorization to return the product to LumiSource®. You will need to pack the product securely in packaging providing at least the degree of protection of the original carton and packing materials and ship it to us at your expense. You will also need to include with the product (a) a copy of your original proof of purchase (retail receipt) showing the date of purchase and (b) a detailed explanation of the problem(s) requiring service.
TO THE EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, ORAL OR WRITTEN, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY LAW, LUMISOURCE® HEREBY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT APPLICABLE STATE LAW EXCLUDES SUCH DISCLAIMERS, THEN TO THE EXTENT ALLOWED BY LAW, THE TIME FOR ANY CLAIMS FOR SUCH IMPLIED WARRANTIES SHALL EXPIRE 90 DAYS FROM THE DATE OF ORIGINAL CONSUMER PURCHASE. TO THE EXTENT PERMITTED BY LAW, LUMISOURCE® IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF TIME, INCONVENIENCE, LOSS OF USE OF YOUR PRODUCT, OR PERSONAL INJURY OR PROPERTY DAMAGE, CAUSED BY YOUR PRODUCT OR ITS FAILURE TO WORK.
This limited warranty gives you specific legal rights. Some states do not allow the exclusion or limitation of incidental or consequential damages, and applicable law may not permit the exclusion of certain implied warranties. You may also have other rights, which vary, from state to state.
 

CANCELLATION AND RETURN POLICY

There is a 20% restocking fee for all cancelled orders or product returns. The product must be unopened, and in its original packaging. These must be cancelled or returned within 30 days of the original purchase date.  The customer must pay for any return shipping charges. Refunds will be granted within 3-5 business days of when it is returned to LumiSource. Please contact us by phone or email and provide your credit card information to grant you a refund.

SHIPPING

All orders placed on this site are subject to product availability and will be shipped according to LumiSource's shipping policies.
In the rare event that your order never arrives, notification of lost items must be received within 60 days from receipt of the shipping confirmation e-mail.
All orders will be processed and shipped within 7 days of receipt of your order. You will be notified if there is any reason your order will not ship within this time frame and granted a refund upon request if it has not already shipped. All orders will be shipped UPS Ground unless you contact us to make other arrangements. All Free-shipping or reduced shipping promotions will only use UPS Ground. If you want a faster method, you must contact us for a quote and pay the full shipping amount. BoomChair.com does not guarantee any shipping arrival dates, and will not accept returns for this reason. Shipping rates are subject to change at any time.
